In Secretary of State for Business and Trade v Mercer, the Supreme Court has made a declaration of incompatibility in relation to the lack of statutory protection from detriment for taking part in lawful industrial action.

News from IDS Brief: Claimants in stayed proceedings not entitled to documents in lead litigation

In Aird and ors v Asda Stores Ltd and ors the EAT has held that, in large-scale multi-claimant equal pay litigation, an employment judge was entitled to refuse an order requiring the parties to the lead litigation to provide copies of all documents and correspondence to claimants whose claims had been stayed pending the outcome of the lead litigation.
