SRA Professional Indemnity Insurance Rules Waiver

The LawWorks have obtained from the Solicitors Regulation Authority (SRA) a waiver from the Professional Indemnity Insurance Rules.

It is for the benefit of all clinics registered with the LawWorks network. It waives the need for solicitors who volunteer at LawWorks Clinics to be covered by qualifying insurance under the SRA’s Professional Indemnity Insurance Rules provided there is reasonably equivalent indemnity cover in place. This was issued by the SRA to allow for the various insurance positions at clinics and is subject to terms and conditions outlined in the waiver including importantly arrangements with regard to supervision. Solicitors volunteering also need to receive a copy of the waiver. Refer to the waiver for all conditions.

Beyond insurance the instrument waives certain of the other outcomes set out in the SRA code of conduct relating to written prior notification to clients of a complaint procedure; complaint handling and advice as to overall costs of the client’s matter. It does, however, impose conditions related to each of these subjects.

The current waiver expires on 31 March 2023.
