BEIS has today published a consultation: Pregnancy and maternity discrimination: extending redundancy protection for women and new parents

ELA’s Legislative & Policy Committee will be responding to the consultation and would like to invite ELA members to join the working party which will draft our response. The working party will be chaired by Catrina Smith (Norton Rose Fulbright). The deadline for submissions 5 April 2019, so volunteers will need to have availability during February and March to work on ELA’s response.

The consultation page states that it seeks views on extending redundancy protection for pregnant women and new parents. It also sets out more widely what the department is doing to tackle pregnancy and maternity discrimination, and explain the current law on redundancy protection.

This is a commitment in the government’s response to the Taylor Review, and had previously been raised by the Women and Equalities Select Committee (WESC).

The consultation recommends that we extend the current protection afforded under the Maternity and Paternity Leave etc Regulations 1999 (which apply to the period of maternity leave) to cover the period of pregnancy and a period after, an extension of 6 months. It asks how best to achieve that and who would be covered, for example, those taking Shared Parental Leave or Adoption Leave.

How ELA working parties work

A typical working party will organise its work by sharing out the consultation questions amongst the working party members. In this way, the work can be shared out evenly, and members can volunteer to take on as much or as little as they feel able to at the time. Each working party member will then draft a response to the question(s) they have agreed to take on, within the agreed timetable. The submission deadlines are often quite tight, so it is vital that everyone keeps to the timetable. The chair(s) of the working party (who are almost always drawn from the L&P Committee) will then pull the individual submissions together and edit them for consistency, ensuring that our submissions are politically neutral and address the concerns of both employees and employers.
