Commercial property transactions are not something most employment lawyers deal with on a daily basis. They can involve complicated contractual chains, with property managers, facilities managers and a range of sub-contractors in the mix. You may be dealing with a property sale, or with a lease surrender or forfeiture. Employees working at a property may or may not be dedicated to it. An outsourcing may look straightforward, but what if the property’s being sold at the same time?

This session will take a practical look at how TUPE applies in a range of commercial property transactions, covering:

  • An explanation of when Regulation 3(1)(a) and 3(1)(b) are likely to apply and the guidance from the cases
  • TUPE considerations in commercial property sales, including situations where property management services are outsourced and/or facilities management has been sub-contracted
  • Commercial lease surrenders and forfeitures, including where there is a delay before a lease is re-granted
  • How TUPE issues are typically dealt with contractually in the context of a sale or lease
