The law of privilege continues to throw up difficult issues for litigators and advisers alike. This session will review the law in this area in the light of the Court of Appeal’s important recent decisions on litigation privilege in SRO v Eurasian Natural Resources (which also considered the vexed question of the identity of the “client” for the purposes of legal advice privilege) and in WH Holding Ltd v E20 Stadium LLP; and the EAT’s ruling on the iniquity principle in X v Y Ltd.  It will also address the statutory privilege for pre-termination negotiations in unfair dismissal claims, and waiver of privilege.
