Paul Goulding KC of Blackstone Chambers and Editor of Employee Competition: Covenants, Confidentiality, and Garden Leave, will provide an update on recent developments in employee competition.

Topics covered will include:

  • Restrictive covenant cases dealing with new forms of non-competes, the relevance of the type of agreement, how the American Cyanamid test is applied, the effect of delay, severance and cross-border enforcement.
  • Trade secrets and confidential information.
  • The UK Government’s proposed legislation to limit non-competes to a maximum period of three months, the US proposal to ban non-competes, and the likely impact of these measures on drafting covenants and litigating employee competition disputes.
