The Employment Rights (Amendment, Revocation and Transitional Provision) Regulations 2023, will come into force on 1 January 2024.
We shall cover:
- The codification of the five different carry over rights in respect of holiday including the statutory duty on employers to enable holiday
- Including how to extinguish that carry over
- The rights to be paid holiday pay if holiday, including carry over holiday, is outstanding on termination
- The changes to coronavirus carry-over
- The codification of what will be ‘normal pay’
- The new class of ‘irregular hours’ and ‘part year workers’ including the
- Rate at which they accrue holiday
- Rate at which they are paid holiday
- The ability to pay these workers rolled up holiday pay and the necessary formalities when doing so
- First thoughts on problems within the regulations, avoidance and risks
